Lasting Powers of Attorney are very important and powerful documents. You may not have heard of them before. In October 2007 they replaced the system of Enduring Powers of Attorney.

There are two types of Lasting Power of Attorney. One relates to Property & Financial Affairs and the other relates to Health and Welfare, but what do they do?
Lasting Powers of Attorney allow you to decide who will make decisions for you if you lose the ability to do so yourself in the future. You are known as the "Donor". This is the person making the Lasting Power of Attorney.
You appoint an "Attorney" (or you can appoint more than one) who will make decisions for you if you become incapable of doing so in the future. It is another type of forward-planning.
If you later develop dementia or suffer, for example, a stroke, your Attorney can make decisions on your behalf. This can include paying your bills, selling your house for you or even deciding where you live and what care you receive.
Whereas Wills cover the period after you die, and set out who receives your assets, Lasting Powers of Attorney deal with the period while you are still alive, but after you have become unable to deal with things yourself.
It is not the case that your family can automatically make these decisions for you. Anyone who has been in this situation without a Lasting Power of Attorney will be all too familiar with banks and other institutions refusing to discuss accounts and citing "Data Protection" as the reason! The next step is an expensive and time-consuming application to the Court of Protection for something known as a Deputyship Order.
By making a Lasting Power of Attorney you are able to remain in control. You decide who will help you in the future and can provide guidance to them (or impose restrictions on their power, if that is appropriate).
